Intussusception Vaccine Injury Attorney

Have you ever experienced harmful side-effects or health problems after receiving a vaccine? If so, you probably have a lot of concerns and questions. You may be wondering, “How could this happen? Vaccines are supposed to keep me safe, not hurt me”. Unfortunately, although vaccines can help many people, they are also capable of causing injuries to the people who receive them.

Although vaccines are meant to protect us from disease and illness, negative side effects from vaccinations can occur. Adverse reactions to a vaccine range from very mild (e.g., temporary soreness at the site of vaccine administration) to extremely serious (e.g., permanent disability or even death).

If you have experienced Intussusception after receiving a covered vaccine you may be eligible for financial compensation through the NVICP.

What is Intussusception?

One type of adverse reaction people sometimes experience after receiving a vaccine is called Intussusception. Intussusception is a serious condition in which part of the intestine slides into an adjacent part of the intestine. This telescoping action often blocks food or fluid from passing through. Intussusception also cuts off the blood supply to the part of the intestine that's affected. This can lead to infection, death of bowel tissue or a tear in the bowel, called perforation.

What Causes Intussusception?

In adults, intussusception is typically caused by a medical condition or procedure, including a polyp or tumor, scar-like tissue in the intestine, weight-loss surgery or Crohn’s disease.  In most cases of intussusception in children, the cause is unknown.

Unfortunately, Intussusception can also be caused by vaccines.

What Types of Vaccines Case Cause Intussusception

Intussusception has been linked to the rotavirus vaccine.

What Should I do if I Was Diagnosed With Intussusception After Being Vaccinated?

If you have been diagnosed with Intussusception or experienced many of its symptoms after receiving a vaccine, you should contact your doctor right away. Your doctor will help ensure you start a course of medical treatment designed to best address and reduce your symptoms. Be sure to inform your doctor about any vaccine administration details you can remember, including the name of the vaccine(s), as well as the place, date and time of your vaccination. After being notified of your vaccine injury, your doctor is required to fill out a Vaccine Adverse Event Reporting System (i.e., “VAERS”) report. You can also fill out a report yourself on the VAERS reporting website.

You May be Eligible for Compensation for Your Injuries and Damages

When serious adverse reactions to a vaccine occur, the impact can be life-altering and permanent…not just for you, but for your family and loved ones as well. Serious adverse reactions impact many lives.

If you have been diagnosed with Intussusception or have experienced many of its symptoms after receiving a vaccine, you may be eligible for financial compensation. In 1986, Congress passed legislation called The National Childhood Vaccine Injury Act of 1986 (NCVIA). As part of the NCVIA, Congress created the National Vaccine Injury Compensation Program (NVICP). This program allows individuals who have experienced a serious adverse reaction to a vaccine to obtain financial compensation for their injuries and damages.

What is the National Vaccine Injury Compensation Program (NVICP)?

The National Vaccine Injury Compensation Program (NVICP) is the federal program through which people can receive financial compensation when they have been injured by a vaccine. It is a no-fault alternative to the traditional tort system. So, unlike a regular civil action, you don’t need to demonstrate the vaccine manufacturer's negligence or wrongdoing in order to receive compensation. To be eligible for financial compensation through the NVICP, you merely need to prove a covered vaccine caused your injury.

If you have been diagnosed with ITP or have experienced many of its symptoms after receiving a vaccine, you may be entitled to compensation for your injuries and damages. To receive financial compensation, however, you need to act fast, as there are deadlines for filing claims. If you wait too long to file a claim and you miss a deadline, you will be forever barred from seeking compensation through the NVICP.

What Types of Financial Compensation Can I Receive?

If you are successful in proving a covered vaccine caused you to experience an adverse reaction, you will be entitled to receive financial compensation for your injuries and damages. The following is a list of the common types of financial compensation you may be entitled to:

  1. Past and Future Unreimbursed Medical Expenses,

  1. Past and Future Lost Wages, and

  1. Past and Future Emotional, Psychological, and Physical Pain and Suffering.

How Much Money Can I Get from the Vaccine Injury Compensation Program?

The amount of compensation you can receive depends on a variety of factors including, but not limited to:

  1. The type of injury you sustain,

  1. The severity of your symptoms and how long they last,

  1. Whether and to what extent you have lost income due to your injuries,

  1. What medical treatment you receive and how much it costs, and

  1. What damages you will have in the future, etc.

With some exceptions, there typically is no predetermined amount of compensation for vaccine injuries.

How to Receive Financial Compensation for Intussusception Through the NVICP

In order to receive compensation for your vaccine-related injuries and damages, you must file a claim with the Federal Court of Claims in Washington, D.C. The process of presenting a claim and obtaining compensation is complicated. The claim must be proven through the presentation of a wide variety of evidence. Because this is a complex legal process, many people choose to hire legal representation. The experienced vaccine injury attorneys at DuPont & Blumenstiel are here to guide you through the entire process. We can help maximize your chances of receiving financial compensation.

What Does a Vaccine Injury Attorney Do?

A vaccine injury attorney is a lawyer who represents people who have had an adverse reaction to, or have been injured by, a vaccine. An experienced vaccine injury attorney can help you understand your legal rights and options.

Will I Have to Pay Attorney’s Fees and Case-Related Expenses?

Understandably, many people worry they will be held responsible for paying attorney’s fees if they pursue a claim through the NVICP. One great aspect of the NVICP is that our clients don’t have to pay our attorney’s fees or case-related expenses. The Federal Court of Claims will pay the attorney's fees and other legal costs. Win or lose, we will never ask you to pay our fees.

Who Can File a Claim with the NVICP?

You may file a claim through the NVICP if you:

  • Were injured after receiving a covered vaccine,

  • Are the parent or legal guardian of a child or disabled adult who received a covered vaccine, and you believe they were injured by it, and/or

  • Believe that a covered vaccine caused the death of a family member or loved one.

Are There Any Restrictions on Presenting a Claim and Obtaining Compensation?

There are some important limitations and restrictions on who can successfully pursue a vaccine claim. The following are mandatory requirements for presenting a claim and obtaining financial compensation for your vaccine adverse reaction.

  1. Your claim must involve a vaccine covered by the VICP,

  1. Your symptoms must have lasted for six months or longer, required extensive hospitalization and surgery, or resulted in death, and

  1. You must file your claim (called a “petition”) with the Federal Court of Claims in Washington, D.C. before the Statute of Limitations expires.

Statute of Limitation Deadlines for Vaccine Injury Claims

Just like many other areas of law, vaccine injury claims have deadlines (known as a “statute of limitations”) by which a claim must be filed in Court or the injured person will forever lose his or her rights to seek financial compensation.

For cases in which the petitioner did not die, the statute of limitations is 3 years from the first onset of symptoms.

For cases in which the petitioner died, the statute of limitations is 24 months from the date of death, but not more than 4 years from the date of vaccination

It's important to keep these dates in mind so you don't miss an important deadline! If you believe you've suffered an adverse reaction to a vaccine, the time to act isnow.
